There is no situation where an 'NC' licensed asset can be used "by anyone". The purpose and point of the non-commercial license is to prevent people from doing exactly what you suggest, for example creating video content without the written consent of the original content author.

It cannot be used without written permission. Part of our duty as moderators is to try to enforce this policy. We rely on the community to help us by submitting reports. If you feel the resource you linked is violating our policies on NC content, please report it.
Yes, our update yesterday fixed several bugs. Notes are in the #hub-feedback channel on Discord. We also added a duplicate file validation to prevent accidental duplicate file uploads.
Unfortunately yes, the duplicate filename screening is site-wide, and includes images. This is probably causing the error you're seeing. We'll see if we can tweak it on the next update.

You seemed to have answered your own question, but if a plugin uses a morph (timeline, logic bricks, expression tool, etc) then that morph becomes part of your dependencies.
Try the Var Inspector to determine where these dependencies are in your scene.
Update: The official decision is that we will allow "Questionable" or "MISSING" dependencies in Paid content but only if they are already hosted on the Hub and only if they are not from a banned creator.

My apologies, I see you were talking about the Paid category.
Still, "MISSING" or "Questionable" dependencies were never allowed in the Paid category, and now the system detects them automatically. Please contact the author and ask them to update their resource with the correct license.
