END USER LICENSE AGREEMENT
This copy of the Virt-a-Mate 2 Addon Kit (also known as VaM2 Addon Kit) ("The Addon Kit") and accompanying documentation is licensed and not sold. The Addon Kit is to be used in conjuction with the Virt-a-Mate 2 Runtime Application (also known as VaM2) ("The Application"). The Addon Kit is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Mesh VR, LLC or its subsidiaries, affiliates, licensees, and suppliers (collectively "The Company") own intellectual property rights in The Addon Kit and The Application. The Licensee's ("you" or "your") license to download, use, copy, or change The Addon Kit is subject to these rights and to all the terms and conditions of this End User License Agreement ("Agreement").
Acceptance
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY SELECTING THE "ACCEPT" OPTION AND DOWNLOADING THE ADDON KIT OR BY INSTALLING, USING, OR COPYING THE ADDON KIT. YOU MUST AGREE TO ALL OF THE TERMS OF THIS AGREEMENT BEFORE YOU WILL BE ALLOWED TO DOWNLOAD THE ADDON KIT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST SELECT "DECLINE" AND YOU MUST NOT INSTALL, USE, OR COPY THE ADDON KIT.
License Grant
This Agreement entitles you to install one or more copies of The Addon Kit for your use.
Termination
Should you breach this Agreement at any time, your right to the use of The Addon Kit will then immediately terminate and shall terminate without any notice being given. However, all provisions of this Agreement, except for the License Grant, will remain in effect and thus shall survive termination. Upon termination of the License Grant, You MUST destroy all copies of The Addon Kit.
Age Restriction
The Addon Kit contains uncensored sexually explicit material unsuitable for minors. Only adults (1) who are at least 18-years old and (2) who have reached the age of majority where they live may access The Addon Kit. The Company forbids all persons who do not meet these age requirements from accessing The Addon Kit. If minors have access to your computer, please restrain their access to sexually explicit material by using a password restricted account login or other parental control software.
Notice of Explicit Content
The Addon Kit contains content that you may find offensive, indecent, or objectionable, including situations of a sexual nature. This content may or may not be identified as having attributes that you may find offensive. You acknowledge that you use The Addon Kit at your own risk, and the Company has no liability to you for any content you view. Users provide content categories, tags, types, genres, and descriptions, and the Company does not guarantee their accuracy.
Fictional Content
Any names, characters, organizations, locations, or events appearing in this game are fictitious. Any resemblance to real names, characters, organizations, locations, events, etc. is purely coincidental.
Child Pornography Prohibited
The Company prohibits pornographic content involving minors. The Company only allows visual media of consenting adults for consenting adults in The Addon Kit. If you see any visual media, real or simulated, depicting minors engaged in sexual activity within The Addon Kit, please report this to The Company promptly at abuse@virtamate.com. Please include with your report all appropriate evidence, including the date and time of identification. The Company will promptly investigate all reports and take appropriate action. The Company fully cooperates with any law-enforcement agency investigating child pornography.
Use Outside of the United States
The Company is based in the United States. The Company is not making any statement that The Addon Kit or any of its content is appropriate outside of the United States. Use of The Addon Kit might not be legal by certain persons or in certain countries. If you use The Addon Kit from outside the United States, you do so on your own initiative and are responsible for complying with all local laws.
Restrictions on Transfer
Without first obtaining the express written consent of The Company, you may not assign your rights and obligations under this Agreement, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to The Addon Kit.
Restrictions on Use
You may only use The Addon Kit to make addon content for The Application. The Addon Kit may not be used to make content for other 3rd party applications or games.
You may not use The Addon Kit in any way that violates any applicable federal, state, local, or international law or regulation (including any laws regarding the export of data or software to and from the US or other countries).
You may not decompile, "reverse-engineer", disassemble, or otherwise attempt to derive the source code for The Addon Kit, except for the purpose of making content for The Addon Kit or The Application.
Restrictions on Alteration
You may modify The Addon Kit for your own personal use, but you may not distribute modifications or any derivative work of The Addon Kit. Derivative works include but are not limited to translations.
Restrictions on Copying and Distribution
You may not copy any part of The Addon Kit except to the extent that licensed use inherently demands the creation of a temporary copy stored in computer memory and not permanently affixed on storage medium. You may not redistribute The Addon Kit, either partially or in full. The Addon Kit is only available for download to entitled parties through direct links provided by The Company. Redistribution of The Addon Kit by anyone other than The Company is strictly prohibitted.
Disclaimer of Warranties and Limitation of Liability
UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY THE COMPANY, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHER THAN AS SET FORTH IN THIS AGREEMENT OR IN THE LIMITED WARRANTY DOCUMENTS PROVIDED WITH THE ADDON KIT.
The Company makes no warranty that The Addon Kit will meet your requirements or operate under your specific conditions of use. The Company makes no warranty that operation of The Addon Kit will be secure, error free, or free from interruption. YOU MUST DETERMINE WHETHER THE ADDON KIT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO FAILURE OF THE ADDON KIT TO MEET YOUR REQUIREMENTS. THE COMPANY WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE FOR THE LOSS OF DATA ON ANY COMPUTER OR INFORMATION STORAGE DEVICE.
UNDER NO CIRCUMSTANCES SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS OR LOSS OF BUSINESS) RESULTING FROM THIS AGREEMENT, OR FROM THE FURNISHING, PERFORMANCE, INSTALLATION, OR USE OF THE ADDON KIT, WHETHER DUE TO A BREACH OF CONTRACT, BREACH OF WARRANTY, OR THE NEGLIGENCE OF THE COMPANY OR ANY OTHER PARTY, EVEN IF THE COMPANY IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT THE APPLICABLE JURISDICTION LIMITS THE COMPANY'S ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED.
Governing Law, Jurisdiction and Costs
This Agreement is governed by the laws of the state of Indiana in the United States without regard to Indiana's conflict or choice of law provisions.
Severability
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
